IN THE NAME OF GOD AMEN the fourteenth day of July in the year of the reign of ye most gracious sovereign Lord Charles by the grace of God of England Scotland France and Ireland King defender of the faith, as the fourth [1628], I, JAMES SAWKINS of Lyminge in the County of Kent gent being somewhat sick in body but of perfect and sound mind and memory thanks be given to Almighty God therefore do make ordain and declare my testament and last will in manner and form following that is to say,
FIRST, I commend my soul into the hands of Almighty God hoping assuredly through the merits of Christ my Saviour of pardon and remission of all my sins And my body I commit to the earth whereof it was first framed.
ITEM, I give and bequeath unto the pore people of the parish of Lyminge the sum of three pounds to be distributed as amongst them in the day of my funeral.
ITEM, I give and bequeath unto NICHOLAS SAWKINS my son the sum of ten pounds of lawful money of England to be paid unto him or his assigns by my Executrix hereafter named within one year after my decease.
ITEM, I give and bequeath unto my daughter MARGERY and her assigns now the wife of JOHN BEANE of Petham the sum of one hundred pounds of lawful money of England to be paid unto her by my Executrix hereafter named within one year next after my decease.
ITEM, I give and bequeath unto my daughter HELLEN now the wife of THOMAS BECKE of Hinxhill the sum of ten pounds of lawful money of England to be paid unto her or her assigns within half a year next after my decease by my Executrix.
ITEM, I give and bequeath unto my daughter AMY now wife of STEPHEN PLOMER of Aldington the sum of one hundred pounds of lawful money of England to be paid unto her or her assigns within two years next after my decease by my Executrix.
ITEM, I give and bequeath unto ELIZABETH SAWKINS my daughter the sum of three hundred pounds of lawful money of England to be paid unto her by my Executrix in the day of her marriage whensoever it shall happen. In the meantime, my will and meaning is that MARGARET my wife shall yearly and in every year until the day of marriage pay unto her the sum of twenty and four pounds of lawful money of England half yearly by equal portions to be paid towards her maintenance.
ITEM, I give and bequeath unto MARGARET SAWKINS my daughter the sum of three hundred pounds of lawful money of England to be paid unto her by my Executrix in the day of her marriage whensoever it shall happen. In the meantime, my will and meaning is that MARGARET my wife shall yearly and in every year until her day of marriage pay unto her the sum of twenty and four pounds of lawful money of England half yearly by equal portions to be paid towards her maintenance.
ITEM, I give and bequeath unto my daughter ANNE the sum of three hundred pounds of lawful money of England to be paid unto her by my Executrix at her age of one and twenty years or day of marriage which shall first happen.
ITEM, I give and bequeath unto JOHN BEANE my godson and son of my daughter Margery the sum of five pounds of lawful money of England to be paid unto him by my Executrix when he shall accomplish the age of one and twenty years.
ITEM I give and bequeath unto THOMAS BECKE my godson and son of my daughter HELLEN the sum of five pounds of lawful money of England to be paid unto him by my executrix at his age of one and twenty years.
ITEM I give and bequeath unto HENRY BOLDEN of Lyminge one cow to be delivered unto him within one month next after my decease at the choice of my Executrix.
ITEM I give and bequeath unto THOMAS ADCOCKE my servant the sum of five pounds of lawful money of England to be paid unto him by my Executrix within one year next after my decease.
All the residue of my goods, cattle, chattels, place whatsoever my debts and legacies being paid and funeral expenses discharged I wholly give and bequeath unto MARGARET my wellbeloved wife whom I make sole Executrix of this my Testament and last Will.
THIS IS THE LAST WILL AND TESTAMENT of me the said JAMES SAWKINS made and declared the day and year first above written concerning the disposition of all and singular my messuages, lands, tenements, and hereditaments whatsoever in the said County of Kent.
FIRST, I give and bequeath unto MARGARET my said wife all those three score and five acres of marshland with the appurtenances more or less lying and being in the parishes of Ivychurch and Bonington in the said County of Kent And also all that my messuage or tenement barn, stable, and all other edifices and buildings whatsoever thereunto belonging with the appurtenances situate lying and being at a certain place called Hempsted within the said parish of Lyminge together with all courts, ways, yard, backsides, And all the lands, meadows, pastures, woods and feedings whatsoever with the appurtenances to the said messuage or tenement appertaining therewith occupied or letten late purchased of Watts and late were in the occupation of George Johncocke And also one acre of land lying in a field called Potte in Lyminge aforesaid together with the sindmill thereupon standing.
ALSO I further give and bequeath unto MARGARET my wife all that my messuage or tenement with the appurtenances situate and being at Hempsted aforesaid in the said parish of Lyminge together with all the Courts, ingarde, backsides, ways, meadows, lands, pastures, woods and feeding whatsoever thereunto belonging or appertaining or therein and usually occupied and holden late purchased of Thomas Nott and also one piece or parcel of land commonly called or known by the name of Pol lands with the appurtenances late purchased by me of Richard Jenken and lying in Lyminge aforesaid.
ALSO, I further give and bequeath unto the said MARGARET my wife all that my messuage or tenement and lands with all and singular their appurtenances situate lying and being in Lyminge aforesaid which I late purchased of William Watson.
ALSO, I further give and bequeath unto the said MARGARET my wife all that my said messuage or tenement with the appurtenances in Lyminge aforesaid And all the lands meadows pastures and woods with the appurtenances whatsoever thereunto belonging or appertaining now in the tenure or occupation of William Swayne or of his assigns And also one piece or parcel of meadow grounds commonly called or known by the name of Staplefield lying in Lyminge aforesaid and all my right title and interest therein.
ALSO I give and bequeath unto the said MARGARET my wife all that my messuage or tenement, lands with the appurtenances situate lying and being in Lyminge aforesaid which I late purchased of Henry Strowd and James Lucas or of either of them To have and to hold all and singular the said messuages lands, tenements before recited with the appurtenances unto the said MARGARET my wife and her assigns for and towards the payment of my legacies and maintenance of my children until JAMES SAWKINS my son shall accomplish the full age of four and twenty years And then I give and bequeath unto the said JAMES SAWKINS my son all and singular my said tenements, lands, meadows, pastures, woods and feedings whatsoever with the appurtenances before recited or mentioned To have and to hold unto him the said JAMES SAWKINS my son, and to the heirs males of his body lawfully to be begotten And for default of such issue I give and bequeath all and singular my said messuages, lands, tenements, meadows, pastures, woods and feeding whatsoever before recited unto WILLIAM SAWKINS my son and to the heirs males of his body lawfully to be begotten And for default of such issue of the body of the said WILLIAM I give and bequeath the same unto the right heirs of the said JAMES SAWKINS my son forever.
ITEM, I give and bequeath unto the said MARGARET my wife all that my messuage or tenement with the appurtenances commonly called the Well House situate in Lyminge aforesaid together with all the lands, meadows, pastures, woods, and feedings whatsoever with the appurtenances therewith belonging late purchased of Robert Spicer To have and to hold unto her the said MARGARET for and during the term of her natural life. And after the decease of the said MARGARET my wife, I give and bequeath the same unto the said JAMES SAWKINS my son and to the heirs male of his body lawfully to be begotten, And for default of such issue I give and bequeath the same unto WILLIAM SAWKINS my son and to the heirs males of his body lawfully to be begotten And for default of such issue of the body of the said WILLIAM I give and bequeath the same to the right heirs of the said JAMES SAWKINS my son forever.
ITEM, I give and bequeath unto the said MARGARET my wife all that my messuage or tenement with the appurtenances, And all the lands, meadows, pastures, woods, and feedings whatsoever with the appurtenances thereunto belonging situate lying and being in the parish of Hastingleigh and within the said County of Kent now in the tenure or occupation of John Paine the younger or of his assigns And also one piece or parcel of land containing by estimation four acres more or less with the appurtenances now in the tenure or occupation of John Paine the elder and lying in the said parish of Hastingleigh and Why [Wye] aforesaid or one of them To have and to hold the said messuage or tenement meadows, lands, pastures, woods, and feedings with the appurtenances in Hastingleigh and Wye aforesaid unto the said MARGARET my wife and her assigns until my said son JAMES shall accomplish his age of one and twenty years And then I give and bequeath the same unto the said JAMES SAWKINS my son And to the heirs males of his body lawfully to be begotten And for default of such issue I give and bequeath the said messuage or tenement lands, meadows, pastures, woods, and feedings with the appurtenances in Hastingleigh and Wye aforesaid unto my said son WILLIAM SAWKINS and to the heirs males of his body lawfully to be begotten And for default of such issue I give and bequeath the same unto the right heirs of the said JAMES SAWKINS my son forever.
ITEM, I give and bequeath unto MARGARET my said wife all that my messuage or tenement with the appurtenances commonly called Upper Audesden and all the lands, meadows, pastures, woods, and feedings whatsoever with the appurtenances thereunto belonging situate lying and being in the parish of Waltham in the said County of Kent and now in the tenure or occupation of John Bolden or of his assigns.
ALSO, I further give and bequeath unto MARGARET my said wife all that my messuage or tenement with the appurtenances called Lower Audesden And all the lands, meadows, pastures, woods and feedings whatsoever with the appurtenances thereunto belonging or appertaining situate, lying or being in the said parish of Waltham now in the tenure or occupation of Paul Stroud or of his assigns.
ALSO I further give and bequeath unto the said MARGARET my wife all that my messuage or tenement with the appurtenances called White Acre and all the lands, meadows, pastures, woods, and feedings whatsoever with the appurtenances thereunto belonging or appertaining situate lying or being in the said parish of Waltham, and now in the tenure or occupation of George White or of his assigns To have and to hold all and singular my said messuages lands tenements meadows pastures woods and feedings whatsoever with the appurtenances before mentioned in the said parish of Waltham unto the said MARGARET my wife to her assigns until my son WILLIAM SAWKINS shall accomplish his age of six and twenty years, towards the payment of my debts and legacies And immediately from and after his said age of six and twenty years All and singular my said messuages, lands, tenements, meadows, pastures, woods, and feedings whatsoever with the appurtenances in the said parish of Waltham I give and bequeath unto WILLIAM SAWKINS my said son and to the heirs male of his body lawfully to be begotten And for default of such issue I give and bequeath the same unto JAMES SAWKINS my son, and to the heirs of the body of the said James lawfully to be begotten And for default of such issue of the body of the said JAMES I give and bequeath the same unto the right heirs of the said WILLIAM forever.
ITEM, I give and bequeath unto the said MARGARET my wife all that my messuage or tenement with the appurtenances called Connells whatsoever with the appurtenances hereunto belonging or appertaining situate lying and being in the said parish of Waltham now or late in the tenure or occupation of Samuel Bridgeman or of his assigns To have and to hold unto her the said MARGARET and her assigns for and towards the payment of my debts and legacies, bringing up and education of my children until my said son WILLIAM shall accomplish his full age of one and twenty years And then I give and bequeath the said messuage tenement called Connells with the appurtenances, and all the lands, meadows, pastures, woods, and feedings thereunto belonging or appertaining unto my said son WILLIAM SAWKINS and to the heirs male of his body lawfully to be begotten And for default of such issue of the body of the said WILLIAM I give and bequeath the same to JAMES SAWKINS my said son and to the heirs male of the body of the said JAMES lawfully to be begotten And for default of such issue of the body of the said JAMES I give and bequeath the same to the right heirs of the said WILLIAM forever.
ITEM, my will and meaning is and I do hereby give full power and authority unto MARGARET my said wife that she shall at any time hereafter bargain and sell unto any person or persons whatsoever all that my messuage or tenement with the appurtenances called Great Capell and all the lands, meadows, pastures, woods, and feedings whatsoever with the appurtenances hereunto belonging or appertaining situate lying and being in the parish of Petham in the said County of Kent and now in the tenure or occupation of Simon Carden or of his assigns and of me the said James Sawkins And the money for which the same shall be so sold my will and meaning is shall be used and employed towards the payment of my debts and legacies. But, if in case my said wife shall not at any time during her life bargain and sell my said messuage or tenement with the appurtenances called Great Capell, and all the meadows, lands, pastures, woods, and feedings thereunto belonging or appertaining, then after the decease of the said MARGARET my wife, I give and bequeath the same unto JAMES SAWKINS my said son and to the heirs male of his body lawfully to be begotten And for default of such issue to the said WILLIAM SAWKINS my son and the heirs male of his body lawfully to be begotten And for default of such issue unto the right heirs of the said JAMES forever.
